Your purchase of a tailgate package, patron badge and attendance at the Queen’s Cup Steeplechase constitutes and evidences your acceptance in full of the Terms of Use Agreement.
GENERAL RULES & REGULATIONS
Vehicle passes and badges must be presented to enter the race grounds. When allowed, lost or left credential must be purchased, at race day prices, in order to gain entry to the race grounds. Badges must be worn at all times. Oversized vehicles are not allowed in tailgate areas. Overcrowding of tailgate spaces is cause for being ejected from the race grounds. Bus passes are only issued to those getting four (4) tailgate spaces side by side and must be purchased by calling the Queen’s Cup office. Drop offs are ONLY allowed at the designated location inside Gate 1. (Patrons with Member’s Hill Parking Passes may be dropped off behind Member’s Hill ) This is a Rain or Shine event, with absolutely no refunds. For wind risk, personal safety and enjoyment of all of our guests and race participants (horses & jockeys), patron supplied pop-up tents, canopies, standing or and pop-up umbrellas are NOT ALLOWED. In addition the following are NOT allowed: car wraps, roof top carriers, overcrowding of spaces, pets of any kind, open flame cookers, gas grill over 3lbs, glass, banners, flags, distribution of political or promotional materials, loud music and on-premise third party vendors. THESE RULES WILL BE STRICTLY ENFORCED.
Disorderly behavior will be cause for ejection from the race grounds. Gates open at 10:00am & close promptly at 7:00pm. Shirts, shoes, proper and appropriate attire, are required at all times.
ASSUMPTION OF RISK; LIABILITY; INDEMNITY.
Except as otherwise stated, the badge is a personal revocable license that entitles only the bearer (“Licensee”) admission to and within certain areas of the Charlotte Steeplechase Association (the “Property”) only for the race date event (the “Event”) as stated on the badge. Licensee assumes all risk of personal injury to or for any damage to and loss of property of Licensee arising out of, during or related to the attendance of the event held on the Property. Licensee acknowledges the Licensee will be exposed to certain risks of injury including, but not limited to, incidents involving other Licensees who have consumed alcoholic beverages, injury from thrown objects, spills of food or beverages, the unruly behavior of other Licensees including but not limited to walking or running around the Property where the ground me be uneven, the danger of sudden and unexpected lightning storms. Additionally, Licensee may be exposed to or witness traumas related to significant human or equine injuries, or even death, and the general risk associated with dangerous equestrian activities including but not limited to a loose horse within the Property. License agrees to indemnify and hold harmless Charlotte Steeplechase Association, its employees, agents, board of directors, committee members, volunteers, race officials, race sponsors, and National Steeplechase Association, Inc. and their participants and agents (collectively, “Releasees”) from and against any claims, damages, actions, suits and expenses, including attorneys’ fees and other costs, arising out of or related to the Event, the use of alcohol at the Property by Licensee, the conduct and behavior of Licensee, whether such claims and now existing or later arising, and whether or not such loss is alleged to be caused by the negligence of any one of more releases.
USE OF IMAGE, VOICE AND OR LIKENESS GRANTED
Licensee, for itself and any accompanied minor, hereby grants permission to Charlotte Steeplechase Association, Inc. for the use of its image, voice or likeness including any and all recorded images or likeness related to the event that may be filmed, videoed or photographed which may be used for any and all promotional purposes including but not limited to electronic, television broadcast, internet and print media, and further waive all rights to any compensation, as a result of the use of Licensee’s image, name or likeness being used in any way. Licensee also represents that it has legal capacity and authority to act for and on behalf of the accompanied minor and agree to indemnify and hold harmless the Releasees for the use of the image.
